Introduction

This document sets out the Terms and Conditions by which nJoyArt Limited (nJoyArt) agrees to provide services, including the supply of products, to you.

Services – include but are not limited to Painting Sessions (online and in-person), Private hire events (including parties, charitable and corporate), Promotional Events and any event that involves nJoyArt providing a service to you.

Products – include items which are offered by nJoyArt through our e-store or available to purchase in-person and at events.

It is your responsibility to familiarise yourself with these terms and conditions before you book or purchase any of our services. If you are viewing a printed copy, the current version of this document can be found on our Website.

We reserve the right to modify, cancel or append to these Terms and Conditions at any time.


Bookings

Online Sessions

Bookings made on the nJoyArt e-store are instantly reserved, subject to payment completion. The session fee is payable per attendee, not per video connection.

Joining instructions are sent by email. Please add admin@nJoyArt.co.uk to your safe senders’ list to ensure you receive all the information.

Bookings made using the form on our website, by email or phone, are not reserved until the payment method is agreed with us and your place is subsequently confirmed by email.

In-Person Sessions

When bookings are made for in-person sessions or any other event or service provided by nJoyArt, payment is due at the time of booking unless otherwise agreed.

Private Bookings

Private bookings are offered to individuals, for smaller gatherings.

Enquiries for private events are accepted by email, phone or through the contact page on our website. We will discuss and agree on arrangements and fees with you.

The minimum event fee will be required to secure the booking. This will be subject to the Cancellation, Returns & Refunds policy further in this document.

Guest numbers need to be confirmed and paid for in advance. The full balance is required 7 days in advance of the event (unless otherwise agreed at the time of booking).

Additional spaces can be requested up to 48 hours before the event, subject to nJoyArt approval and additional fees.

After the deposit is paid, we can provide a secure payment link for your guests to book and pay their own contribution. Please discuss this with us at the time of booking, if this is required.

Guest places are subject to the Cancellation, Returns & Refunds policy further in this document.

We reserve the right to refuse any event booking without reason.

Corporate Bookings

Corporate bookings are offered to companies, organisations, clubs & societies etc

Enquiries for corporate events are accepted by email, phone or through the contact page on our website. We will discuss and agree on arrangements and fees with you.

Corporate booking fees are on a fixed price basis, based on your requirements. Visit our pricing page for more information.

A deposit equal to the minimum private booking fee is required to secure the booking. This will be subject to the Cancellation, Returns & Refunds policy further in this document.

The full balance is required 7 days in advance of the event.

Special Events (including all-day retreats)

nJoyArt may organise bespoke events, retreats etc, sometimes in collaboration with other organisations. Where bookings are made through nJoyArt, these terms & conditions apply.

We reserve the right to refuse any event booking without reason.


Age Restrictions

Unless otherwise specified our events are developed and intended for adults aged 18+

However, for online sessions, we are happy to welcome families and younger guests that have a desire to take part, on the understanding that they are supervised and can behave appropriately.

For In-Person sessions, we can occasionally allow younger guests but this will depend on the circumstances of the event and the conditions of the venue.

nJoyArt events that are aimed at younger audiences are subject to the same conditions:

  • An adult must accompany younger guests aged less than 18 years (minors). They are wholly and completely the responsibility of the accompanying adult, who must be in attendance for the duration of the event and ensure they, and their charge, behave in a manner suitable for the environment and activities being undertaken.
  • We accept no responsibility or liability whatsoever for minors attending our events or for any exposure to content or environments considered inappropriate for their age.

Exclusion

We do our best to accommodate all individuals. However, we reserve the right to exclude anyone if their behaviour is disruptive or unacceptable for any reason. Our decision on exclusions is final.

Copyright

nJoyArt paintings are Copyright nJoyArt Limited.

nJoyArt grants permission for guests to reproduce their own version of the subject painting at our guided sessions.

Permission extends to the individual recreation of specific works for private use. It is strictly forbidden to use nJoyArt paintings for delivering similar guided sessions to those run by nJoyArt, or for the purpose of commercial gain.

No digital reproduction of nJoyArt demonstrations is permitted for public use or commercial gain without the express permission of nJoyArt. This includes prints and digital copies in any form.

Audio/Visual

We may take photographs (including screenshots and video footage) to document and promote nJoyArt. The images may be made public on a variety of media and platforms.

Your acceptance is assumed unless you let us know otherwise.

Opt-in / Opt-out

In providing your contact information for the purpose of making a booking or attendance at an event, you accept that we may use that information to contact you regarding the event booking and future promotional communication relating to similar nJoyArt activities.

You can opt out of this at any time by contacting us through our contact page or via the link on any email received.


Online Sessions

nJoyArt uses Zoom video conferencing software to deliver its online sessions.

By accepting the Zoom meeting ID and joining the meeting, you agree to the terms set out as follows:

The Zoom meeting ID and information relating to the session are confidential and must not be shared for use with anyone other than to who it was designated.

All guests are required to have a video and audio connection.

If you intend to share the connection with someone in your location, please ensure all guests have booked and paid for their place in the session. The same instruction, level of guidance, and support is provided to all our guests, even if they share a video connection.

Younger guests (under 18 years) are welcome to attend the online session, as long as they are supervised by an adult who is also available for the duration of the session.

Guests are expected to connect to the Zoom session by or in advance of the publicised start time (Zoom will be active up to 15 minutes prior to the start time)

If you are late, know you are going to be late, or are unable to attend at the last minute, please let us know as far as you are reasonably able.

Once the painting demonstration has started (usually within 15 minutes of the start time) we reserve the right to prevent further guests from entering the session.

Digital recording

nJoyArt does not routinely record the Zoom sessions so that we can keep them personalised and comfortable to attend.

  • we may take photographs (including screenshots and video ‘snippets’) to document and promote nJoyArt. The images may be made public on a variety of media and platforms.
  • Your permission is assumed unless you let us know otherwise.
  • Some Zoom facilities will be disabled for guests. This includes but is not limited to the record and screen share functions.
  • Guests are encouraged to send and share photographs of their paintings with nJoyArt and friends for the purpose of promoting nJoyArt activities.
  • Strictly no reproduction of the Zoom session demonstration is permitted for public use or financial gain.
  • Guests are asked to use the mute facility when necessary, to prevent disturbance to other guests from background environments including noise disturbance and others in the room.
  • nJoyArt reserves the right to mute a guest’s audio if deemed necessary for any reason.

When you book and attend an event or receive a service from nJoyArt, either in-person or online, you signify your agreement to these Terms and Conditions.


In-Person Sessions

Please ensure you arrive on time for the session. Once the painting demonstration has started (usually within 15 minutes of the start time) we reserve the right to prevent further guests from entering the session.

Please let us know if you wish to sit with other guests who have booked separately. A booking consisting of more than 1 place will automatically be seated together.


COVID-19

nJoyArt takes its responsibility very seriously with regard to the Government Guidelines in respect of coronavirus. We want our guests to feel confident that the necessary precautions are in place. Should we be required to place restrictions, please ensure you have read the Information for Attendees, which details the precautions currently in place.


Cancellations, Returns & Refunds

Events

You may cancel your booking at any time for any reason by contacting us by email or through our website contact page.

Public events:

  • If you cancel more than 48 hours before the event, you can either:
    1. Reschedule to another event, subject to availability and any necessary fee adjustments.
    2. Request a full refund.
  • If you cancel within 24-48 hours before the event start time, you can either:
    1. Reschedule to another event, subject to availability and any necessary fee adjustments.
    2. Forfeit your fee.
  • If you cancel less than 24 hours before the event or fail to attend without prior notice, your full fee will be forfeited.

Special Events (including all-day Retreats)

  • If you cancel more than 7 days before the event, you can request a full refund.
  • If you cancel within 7 days of the event, your full fee will be forfeited.
  • Please note: Any accommodation or services booked directly with the venue are subject to their own cancellation policies.

Private bookings

  • If you cancel more than 7 days before the event, you can either:
    1. Reschedule to an alternative date, subject to availability and any necessary fee adjustments.
    2. Request a full refund.
  • If you cancel within 7 days but more than 48 hours before the event, you will forfeit the minimum booking fee.
  • If you cancel less than 48 hours before the event, you will forfeit the full fee.

Corporate bookings

  • Corporate bookings are priced at a fixed rate. If you cancel more than 7 days before the event, you can either:
    1. Reschedule to an alternative date, subject to availability and any necessary fee adjustments.
    2. Request a full refund.
  • If you cancel within 7 days but more than 48 hours before the event, you will forfeit the minimum booking fee.
  • If you cancel less than 48 hours before the event, you will forfeit the full fee.

Cancellation by nJoyArt

If nJoyArt needs to cancel an event for any reason, we will aim to reschedule. If this is not possible or the date does not suit you, we will offer a full refund (subject to the Cancellation & Refund conditions herein).

We reserve the right to modify any elements of the event as advertised in our promotional materials, without any commitment to offer a refund for any portion of the fees paid.

Products

All returns must be approved by us before any items are sent. We reserve the right to refuse returns if not adhered to.

Products that are purchased from us, but no longer required or wanted can be returned for a refund. They must be in their original saleable condition, unopened and in original packaging. Postage is the responsibility of the customer and should use a comparable service to that was used to deliver the items to you.

Upon receipt, the items will be inspected. Where accepted, a full refund, minus postage costs, will be issued. If the products are not in original condition, we will contact you to advise a resolution. This could result in a reduced refund, restock fee or no refund.

If you consider a product to be faulty, or you have a complaint, you are required in the first instance, to contact nJoyArt via email or through the contact page on our website, to discuss.

We will evaluate your observations and aim to resolve any such issues with reasonable consideration and agreement.

Your statutory rights are unaffected.


Disclaimer

nJoyArt assumes no responsibility or liability for

  • Loss or damage suffered or caused to any person or person’s possessions as a result of the use or misuse of any art materials.
  • Stains on clothing/materials (Acrylic paint stains fabric!).
  • Adverse skin reactions resulting from the use of materials during the session.

nJoyArt provides (at in-person events) and advises the use of aprons. Other protective equipment can be used as appropriate at your discretion and full responsibility.

We do not accept responsibility for any loss or expense due to circumstances beyond our control, including, but not limited to, delays in public transport, weather, quarantine, sickness, industrial action, terrorism, fire etc


Personal Information

We comply with the legal requirements for the storage and handling of your personal information, including adhering to GDPR. This is covered by our Privacy Policy available on our website.
